Caffeinated Bob — Terms of Service & Privacy Policy

1. The Service

Caffeinated Bob (the "Game") is provided by VidSource, LLC, a Nebraska limited liability company ("we," "us," "our"), as free entertainment software, offered "as is" and "as available," without warranties of any kind, express or implied.

The Game's references to "Employees," "Employee Files," "shifts," "Compliance Vouchers," and the like are part of its fiction. Playing the Game does not make you an employee, contractor, or agent of VidSource, LLC, and no employment or other relationship is created.

2. Beta Software

The Game is currently offered as a beta. Features may change or be removed, bugs are expected, and we may reset, migrate, or delete saved progress (including Compliance Vouchers and cosmetic items) at any time, with or without notice, as part of development. We do not guarantee that progress will carry forward from the beta to any later version.

3. Compliance Vouchers

The in-Game currency "Compliance Vouchers" has no real-world monetary value. It cannot be purchased with real money, withdrawn, cashed out, or exchanged for real currency, goods, or services outside the Game, and is earned only through gameplay.

4. Support Payments

You may optionally make a one-time voluntary payment ("Support Payment") through the in-Game "Support the Dev" feature. Support Payments are processed by our third-party payment processor, Stripe, Inc., subject to Stripe's own terms; we never receive or store your card details.

Support Payments are voluntary and non-refundable, except where required by applicable law. A Support Payment does not entitle you to any goods, services, in-Game currency, in-Game item, feature, or other consideration. Support Payments are not charitable contributions, are not made to a nonprofit organization, and are not tax-deductible. By making a Support Payment, you confirm you are authorized to use the payment method provided.

Support Payments are made in U.S. dollars, and we email a receipt to the address you provide. We may decline, cancel, or refund any Support Payment at our discretion, including where we suspect fraud or unauthorized use. If you dispute a Support Payment with your card issuer, we may restrict your access to the Employee File or the Game while the dispute is resolved.

5. Accounts

You may optionally create an account, referred to in-game as an "Employee File", which saves your in-game progress and data. You create one by entering your email address in the Game; we send a one-time sign-in code so your progress follows you to another computer or browser. An account is never required to play the Game, and no password is ever created or stored.

Sign-in is handled for us by a third-party authentication provider, and protected by an automated, invisible check that confirms you're a person and not a bot. Your saved career is stored on our servers under an anonymous account identifier, not your name. See the Privacy Policy below for which providers are involved, what is collected, and how it's used.

Progress Conflicts. If you play without an Employee File, or while signed out of one, your progress is stored locally on that device. If you later sign in — on that device or another — and your account already has progress on file, we decide which version to keep; the other is not guaranteed to carry forward and may not be recoverable. As stated above, Compliance Vouchers have no real-world monetary value, and we are not liable for any loss or discrepancy in Compliance Vouchers or other in-Game progress, however it occurs.

6. Nameplates

You may optionally choose a display name for your Employee File, referred to in-game as a "Nameplate". A Nameplate is shown on the Game's leaderboards alongside your in-Game Employee number, never instead of it, and only to players who are signed in to an Employee File. Visitors who are not signed in see Employee numbers only. If you use co-workers (Section 8), your Nameplate is also shown to your co-workers as the sender of your emails, including in any notification emails they have asked for, and there it may appear without your Employee number. Choosing one is entirely optional and is never required to play.

What a Nameplate may not contain. You agree not to choose a Nameplate that: contains personal information about you or anyone else (including a real name, address, email address, phone number, or account handle); impersonates another person, another player, us, or any part of the Game; is obscene, hateful, harassing, or otherwise offensive; or is chosen to evade a previous removal.

Our discretion. Nameplates are screened automatically when submitted, and other players can report one. We may decline, remove, or reset any Nameplate at any time, at our sole discretion and without notice, and we may withdraw the ability to choose one. Repeated violations may result in suspension or termination under Section 21. Removing a Nameplate does not affect your Employee number, your saved progress, or your access to the Game.

Changing it. Limits apply to how often a Nameplate may be changed; these are shown in the Game and may change. A Nameplate you give up may be held for a period before anyone else can choose it.

7. Files You Create

Some programs on the in-Game computer let you make things of your own — drawings, written documents, presentations, and photographs of your own in-Game office — and save them to the in-Game Documents folder. A photo of this kind is a picture of your own Bob and the office you have decorated, drawn by the Game from the items on your account; it is not a photograph of you, it does not use your device’s camera, and the Game has no access to any camera, microphone, or photo library on your device. This section is about those files. It does not apply to your saved game progress, which is covered under “Gameplay data” in the Privacy Policy below.

They are yours. You keep whatever rights you have in what you make. We do not claim ownership of it, and Section 12 (Intellectual Property) is about the Game itself, not about your files. To run the Game at all we need your permission to store your files on our servers, to send them back to your own browser, and to show them to you inside the Game. If you attach a file to an email to a co-worker (Section 8), you also give us permission to copy it and deliver it to that co-worker, and you give them permission to keep their copy and send it on to their own co-workers in the Game. That, together with handling reported content as Section 8 describes, is the whole of the permission we are asking for. We do not use your files for anything else, we do not show them to other players unless you send them, and we do not use them to advertise or promote the Game.

They are private unless you send them. Files you save are visible only to you, when signed in to your own Employee File. There is no way for another player to browse, search, or open them. The only way another player sees one of your files is if you choose to attach it to an email to a co-worker, one file at a time; they then receive a copy (Section 8).

An Employee File is required. Saving files needs an Employee File, so Section 10 (Eligibility) applies: the Game is not for anyone under 13.

Limits. There are limits on how many files you may keep, how large each one may be, and how much you may store in total. The current limits are shown in the Game and may change. We may refuse to save a file that would exceed them.

We do not promise to keep them. This is the part most easily missed, so it is said plainly. The Game is beta software (Section 2). We make no promise that a file you save will still be there tomorrow. Files may be lost, corrupted, or deleted — through a fault, a mistake, the course of maintenance, or a change to how the Game works. We do not run backups on your behalf, and we cannot recover a file once it is gone. If something you make in the Game matters to you, keep your own copy of it outside the Game.

We may remove content. Section 13 (Acceptable Use) applies to what you save as well as to how you play. We may remove a file, or withdraw the ability to save files, at our sole discretion and without notice — including where a file is unlawful, infringes somebody else's rights, or is being used to store or distribute something that has nothing to do with playing the Game. We do not routinely look at what you make, and nothing here obliges us to; the exception is a file attached to an email that is reported to us (Section 8).

Deleting them. You can delete your own files inside the Game at any time. A file or folder you delete first goes to the Game's trash (called Disposal, or Recently Deleted on a phone), where only you can see it and where you can restore it or delete it for good; whatever is still there is deleted automatically at the end of that day's after-hours window (11 PM on your own clock, and never more than about 30 hours after you deleted it). Deleting your Employee File deletes the files saved to it. Deleting a file does not delete copies you have already sent to co-workers. We are not required to keep a copy of anything you delete, and once it is gone we cannot bring it back.

8. Co-workers and Email Between Employees

We may offer a feature that lets Employees connect as "co-workers" and send each other email inside the Game. This section applies whenever that feature is available to you. Like everything in the Game, it may change or be withdrawn (Section 2).

Co-workers are real people. A co-worker is another real person playing the Game, not a character. We do not verify who anyone is or how old they are, and another player may not be who they say they are. Co-workers need an Employee File, so Section 10 (Eligibility) applies: you must be at least 13.

How you connect. The only way to become someone's co-worker is with a code. You can share your code with whoever you choose, or enter a code someone shared with you, which sends them a request. You become co-workers only when the person receiving the request accepts it; they can also decline it or block the sender. There is no directory, search, or list of suggested co-workers. A code can be used by up to 5 different people and expires 5 days after it is made, whichever comes first, after which the Game gives you a new one; until then, anyone who has it can use it to send you a request, so share it only with people you mean to. You can replace your code at any time, which stops the old one from working.

What your co-worker receives. An email you send — its subject line, its text, and any drawing, document, presentation, or photo attached to it — is delivered to the co-worker you chose, who can read it and see who sent it (your Nameplate, or your Employee number if you have none). An attachment is a copy of your file as it was when you sent it; changing or deleting your own file afterwards does not change theirs. Your co-worker can save that copy to their own files and attach it to emails of their own. Once an email is sent, it cannot be unsent. Your co-workers can also see your current Clock In Streak (the number of consecutive workdays you have clocked in) beside your name in Contacts.

You are responsible for what you send. You alone are responsible for the emails and files you send. You agree not to send anything that: shares contact details for you or anyone else, such as a phone number, email or street address, a web link (other than a link to the Game’s own website, caffeinatedbob.com, or any page on it), or social media or gaming handle; tries to move a conversation off the Game or arrange to meet; is hateful, including slurs; is sexually explicit, or sexualizes a minor in any way; harasses, threatens, or impersonates anyone; is spam; infringes somebody else's rights; or otherwise breaks Section 13 (Acceptable Use) or the law.

Automated filtering, and its limits. Before an email is delivered, its text is checked automatically — the subject line, the message, and the words inside an attached document or presentation — for slurs, sexual content, and contact details or attempts to move off the Game. An email that fails the check is not sent. The check cannot read drawings or photos, and it does not catch everything. It is not a promise that anything you receive is safe or appropriate.

Other players' emails are theirs, not ours. Emails and attachments are written and made by the players who send them, not by us. We do not create, approve, or endorse them, and we are not responsible for them, or for anything a co-worker says or does, in the Game or outside it. Section 15 (Limitation of Liability) and Section 20 (Indemnification) apply to co-worker email, including anything you send.

Private, but not unseen. We do not routinely monitor or read emails between Employees. We do review an email, including its attachment, when it is reported to us, and we may look at other emails between the same Employees to understand the report. We reserve the right to access, review, and remove any email or attachment, at any time and for any reason, and by using co-workers you consent to this.

Reporting, removing, and blocking. The Game lets you report any email you receive, remove a co-worker, and block a co-worker. Removing someone ends the connection; a new code could connect you again. Blocking ends the connection too, and stops that person from connecting with you through any future code of yours. Unblocking lifts your block, and if the two of you were co-workers when you blocked them, it puts that connection back — so a block can be temporary — unless they have blocked you in the meantime, in which case their block stands, or their account no longer exists. The Game does not tell the other person that you reported, removed, blocked, or unblocked them. We review reports, but we cannot promise a particular outcome or how quickly we will act. If you are ever in immediate danger, contact local emergency services.

Our discretion. We may remove any email or attachment, limit or withdraw your ability to connect with co-workers or send email, and suspend or terminate your access under Section 21, at our sole discretion and without notice.

Law enforcement and child safety. We may preserve emails, attachments, and account information, and disclose them to law enforcement or others, where we believe in good faith that the law requires or permits it or that it is needed to protect someone from harm. If we become aware of apparent child sexual exploitation, we report it to the National Center for Missing & Exploited Children (NCMEC), as U.S. law requires, and preserve the related content and account information as the law requires.

How long emails are kept. The text of an email is kept for one year after it is sent, then deleted. An attachment stays on the email for 30 days, then is deleted, and the email shows that it is gone. A copy your co-worker saved to their own files before then is one of their files under Section 7. Reported emails and attachments are kept, regardless of age, for as long as we need them to review the report and meet our legal obligations. Emails you have already sent may remain with the co-workers who received them, within these periods, even if you delete your Employee File. These are the longest we intend to keep emails, not a promise to keep them that long (Section 2).

Limits. Limits apply to how many emails and attachments you may send, how often you may email the same co-worker, and the hours when you may send, in your local time. The Game tells you when you reach one, and limits may change.

Notifications to your personal email. You can choose to be told by real email, at the address on your Employee File, when a co-worker's email is waiting unread. This is off unless you say yes, and you can change your answer in the Game at any time. A notification names the sender by Nameplate or Employee number and includes the email's subject line, never its message or attachment. Notifications are sent only on weekdays during working hours in your local time, and no more often than every two hours. Every notification includes an "Unsubscribe from these notifications" link, which turns off co-worker notifications only; it does not affect any other email from us. The page that link opens also lets you stop all email from us, if you would rather.

9. Sharing Your Results

The Game lets you share a summary of a day's play. A shared summary contains your in-Game Employee number, the day number, the Game's rating of that day, and the in-Game statistics shown on that day's review. Choosing to share creates a page at a link that anyone holding the link can open, whether or not they play the Game, and hands that link to the destination you chose.

A shared summary contains no email address, no name, and no information about how long you played. Your in-Game Employee number is already displayed publicly on the Game's leaderboards. A shared summary never contains your Nameplate. Nothing is published unless you choose a destination yourself; sharing is entirely optional and is never required to play.

We keep a shared summary for one year from the day it is created, after which the link stops working. We may remove a shared summary at any time. If you would like one removed sooner, contact us at the address below.

Once you share, the destination you chose — a social network, a messaging app, or anyone you send the link to — is outside our control and governed by its own terms and privacy policy, not ours. We cannot recall a link that has already been posted or forwarded.

10. Eligibility

Caffeinated Bob is intended for a general audience. You must be at least 13 to create an Employee File, submit feedback with your email, or otherwise give us your email address. You must be at least 18 (or the age of majority where you live) to make a Support Payment; if you are younger, a parent or guardian must make it for you using their own payment method. If we learn a child under 13 has given us personal information, we will delete it — contact us at the address below.

11. Sanctions & Export Compliance

By making a Support Payment, you represent that you are not located in, and are not a national or resident of, any country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties.

12. Intellectual Property

We grant you a personal, non-exclusive, non-transferable, revocable license to play the Game for your own non-commercial entertainment, subject to these Terms.

The Game and its protectable content, including its software, art, music, writing, and design, are owned by or licensed to VidSource, LLC and protected by applicable intellectual property laws. You may not copy, modify, reverse-engineer, or redistribute the Game except as expressly permitted by us in writing.

This section is about the Game. It is not about anything you make with it: drawings, documents, and presentations you create and save are covered by Section 7, and we do not claim ownership of them.

13. Acceptable Use

You agree not to: (a) use bots, scripts, or automated tools to play the Game or access our servers; (b) circumvent the bot check, rate limits, or any security measure; (c) tamper with saved progress on our servers, or exploit bugs to gain an unfair advantage; (d) make Support Payments with a payment method you are not authorized to use, or dispute a Support Payment you knowingly made; (e) interfere with the Game's operation or other players' use of it; (f) harass, threaten, or exploit another player; or (g) use the Game for any unlawful purpose.

14. Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDSOURCE, LLC AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE GAME SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

16. Changes

We may modify, suspend, or discontinue the Game, or these Terms, at any time. If we make a material change to these Terms, you will be asked to re-accept them before continuing to use the Game.

17. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Game shall be resolved in the state or federal courts located in Nebraska, and you consent to their jurisdiction.

Before filing a claim against us, you agree to contact us at the address below and give us 30 days to try to resolve it informally. To the extent permitted by law, you and VidSource, LLC agree that any dispute will be brought individually and not as a plaintiff or class member in any class, consolidated, or representative action, and each of us waives the right to a jury trial. Either of us may bring an individual claim in small-claims court instead.

19. Feedback

If you send us feedback, suggestions, or ideas about the Game, you agree that we may use them to improve or develop the Game without any obligation or compensation to you, and that such feedback is not confidential.

20. Indemnification

You agree to indemnify and hold harmless VidSource, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Game.

21. Termination

We may suspend or terminate your access to the Game at any time, with or without notice, for conduct that violates these Terms or that we believe is harmful to the Game or other users.

22. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and VidSource, LLC about the Game. We may assign these Terms to a successor or acquirer of the Game; you may not assign them. Our not enforcing any part of these Terms is not a waiver of it. Sections that by their nature should survive (including Compliance Vouchers, Support Payments, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) survive termination. You agree to receive receipts, notices, and other communications from us electronically.

Privacy Policy

We collect limited information necessary to operate the Game, process Support Payments, and run the optional Employee File:

We do not sell your personal information. We do not knowingly collect information from children under 13. Questions about this Privacy Policy, including requests to delete your Employee File or the data associated with it, can be sent to vidzsource@gmail.com.
